Terms & Conditions

Consultancy

  • Charges for visits to provide advice on plants and/or design (supported with subsequent reports) are based on time spent, mileage incurred and travelling time (if applicable).
  • Garden visits are charged at £50 per hour or part thereof.
  • Mileage is charged at the standard Inland Revenue rate of 45ppm. Local visits within a 10 miles radius of Cobham and Dorking are free of charge.
  • The fee is payable at the end of the consultation.

Design work

  • Design work, the preparation of drawings, specifications etc, is charged at £50 per hour.
  • Clients usually prefer to elect for an inclusive fee for work agreed, plus sundry costs, see below.
  • The Designer will offer a quotation in writing after the Client brief. A deposit is due upon acceptance of commission.
  • Stage payments are due as specified in the quote. The remainder upon presentation of final plans.
  • Payments are due 7 days from the date of invoice.

Monitoring the Works

  • If the Designer is monitoring the Works (the implementation of the garden plans), this will be charged at £50 per hour; a percentage of the total contract value; or an agreed sum. This will be individual to each project depending on the scope of works and Designer involvement, and will be agreed in advance.
  • Payments to be made in line with the contactors' payment staging.
  • Alternatively, single site visits are charged at £50.

Plant Supply

  • Suitable facilities for the receipt and storage of plant material should be arranged by the Client (or Contractor if so agreed by the Client). All temporary storage areas shall be sheltered and well drained. Once plants have been delivered, and checked by the Designer, arrangements for watering and general care until planting, is the responsibility of the Client (or Contractor).
  • Once plants, or plant material, have been agreed to, ordered, delivered, and checked by the Designer, no exchanges or returns are accepted.
  • Once the plants, or plant material, have been delivered, and checked by the Designer as inherently healthy, responsibility cannot be accepted for loss unless, on re-inspection by the supplying nursery, it is proven that the plant was supplied defective or diseased.
  • The Designer is not liable to replace plants for subjective reasons.
  • Once plants, or plant material, have been delivered, and checked by the Designer, their care is the Client’s responsibility - no responsibility can be taken for losses due to pests and diseases, adverse weather conditions and incorrect care by the Client.
  • No responsibility can be accepted for plants or goods provided to you by a Contractor or other separate supplier.
  • A full site survey by the Designer or a surveyor approved by the Designer, is always recommended in order to accurately measure the space. This will enable the Designer to determine numbers of plants to supply. In instances where this has not been carried out, no responsibility can be accepted for the supply of excess numbers of plants.

Sundries

  • Printing of plans and other documents, general printing sundries, postage, or specialist equipment hire are charged at cost plus handling.

Other terms and conditions

  • Only work that is specified in the quote is included in the fees; any additional work will be chargeable on an hourly basis.
  • A quotation is valid for 30 days.
  • Written acceptance of a quotation is required.
  • No allowance is made in the quotation for any extra design work required due to unknown, or hidden underground features.
  • The quotation is based on all the design work being undertaken at one time – additional costs may be incurred if only part of the quotation is accepted.
  • Once approved, all design revisions are chargeable at the stated hourly rate.
  • Should the Client choose not to have the project constructed for any reason, the agreed design fee remains payable. Payment will be due 7 days from the date of the invoice.
  • The Designer reserves the right to charge interest on any late payments. Interest will be charged at 10%, compounded weekly. The Designer may also charge the Client £25 for each presentation of unpaid cheques and any administrative fees levied by a financial institution for such presentations.
  • The obligations of the Designer are limited to the design content of the plans provided. No responsibility can be accepted for any faulty workmanship.
  • Where detailed structural work is involved (e.g. drainage, retaining walls over 1m, foundations, garden buildings and other structural elements), the Designer recommends professional advice is sought from a structural engineer before any implementation of the design or design concept, the costs of which will be borne by the Client. No responsibility can be taken for failure to do so, and the Designer cannot be held liable for any of these costs, or consequences for not consulting a structural engineer or other professional.
  • During the tendering process and the garden build, the Designer may introduce the Client to potential Contractors. The Designer cannot be held responsible for delays in the quotation process. Any contract arranged will be between the Client and the Contractor. The Designer cannot be held responsible for any delays in the Works, or faulty workmanship by the Contractor. The Designer shall not be liable for any indirect, incidental or consequential damage, including, but not limited to, lost profits of any kind.
  • Project monitoring, where applicable, will be charged at the stated hourly rate, a percentage of the project, or an agreed sum. This will be individual to the project depending upon the scope of works, Designer involvement and would be agreed upon.
  • In the event of a cancellation a charge will be made for any works undertaken and will be charged at the stated hourly rate plus a £50 cancellation fee.

Definitions

  • 'The company' is defined as Lisa Edge Davies and Nicola Warnants, trading as Harmony Green Garden Design Dorking and Harmony Green Garden Design Cobham respectively.
  • 'The Designer' is defined as Lisa Edge Davies or Nicola Warnants.
  • ‘The Client’ is defined as the person or persons that request Harmony Green Garden Design to carry out work.
  • 'The Contractor' is defined as the person or persons contracted by the Client to carry out the Works.
  • 'The ‘Works’ is defined as all the hard and soft landscaping including preparation, construction and planting work undertaken at the site to implement the Design.

Intellectual Property Rights

  • All designs, sketches/ documents prepared by the company are the intellectual property of the company and are subject to copyright law. These remain the property of the company until paid for in full and are for the sole use of the Client and cannot be transferred to another party or designer.
